1. Scope and contracting party
These terms apply to all services of Nocentcetra GmbH, Margaretenstraße 78, 1050 Wien (Nocentcetra recording studio), for consumers and business clients.
Your contractual partner is Nocentcetra GmbH only (register FN 591205 p, VAT ATU66152922). Your own terms apply only if we confirm them in writing. The German version of these terms is legally authoritative.
2. Services and indicative prices
We provide studio work as described on the website, including Vocal recording, Mixing, Mastering, Band recording and Podcast recording. Guide prices (incl. 20 % VAT):
| Service | Price |
|---|---|
| Vocal recording | €105 / €369 |
| Mixing | €225 / €85 / €98 |
| Mastering | €92 / €265 |
| Band recording | €138 / €829 |
| Podcast recording | €96 / €62 |
Net amounts for businesses: e.g. €87.50 per vocal hour. Extra work (overtime, express delivery, additional stems) is charged only when agreed in writing. Process details are on each service page and in our Guides.
3. Quotes and contract formation
Enquiries via Contact, email or phone are non-binding. We send a binding quote in writing (email is enough) with scope, date, price, deposit and any special terms.
The contract is concluded when you accept the quote in writing and the agreed deposit reaches our account. For distance contracts with consumers we provide mandatory pre-contract information under Austrian distance-selling law, including withdrawal rights and our privacy policy.
4. Deposit and payment
To hold a date we require a deposit of 30 % of the agreed total. It is credited against the final invoice. For consumers the balance is due before the session starts, or before delivery of final files for remote mix/master work, unless we agree otherwise.
Business clients may receive invoices with 14 days to pay. Late payment may lead us to suspend work and charge statutory interest.
Payment by bank transfer; card payment in the studio by prior arrangement. Until full payment we may withhold final exports; raw material is handled under article 10.
5. Sessions, hours and access
Opening hours: Monday–Friday 10:00–20:00, Saturday 10:00–16:00; closed Sunday. Evening sessions by appointment.. Directions: U4 Pilgramgasse station (about 4 minutes on foot). Bus 13A stop Schönbrunner Straße / Mittersteig. From Wien Hauptbahnhof take U4 towards Hütteldorf to Pilgramgasse.. Please arrive on time; late arrival shortens the booked slot if the next booking follows.
Evening slots outside regular hours need written confirmation. We provide 6 headphone sets and an engineer; we can test your gear but do not warrant third-party equipment.
6. Right of withdrawal (consumers)
Consumers who conclude a distance contract may withdraw within 14 days of conclusion without giving reasons, where the law allows. Send a clear statement to [email protected] or by post to Margaretenstraße 78, 1050 Wien.
If you ask us to start before the withdrawal period ends, you must pay a fair amount for work already done if you still withdraw. The right does not apply once the service is fully performed and you agreed to early performance.
For bespoke audio work or digital content that is not prefabricated, withdrawal may be excluded if you agreed to immediate start and acknowledged the loss of the withdrawal right.
7. Cancellation and rescheduling
| When | Effect |
|---|---|
| At least 5 calendar days before the session | Free cancellation or one reschedule; deposit refunded or moved to the new date. |
| Less than 5 days before | Deposit retained as a flat fee unless a replacement date within 60 days is agreed. |
| No-show without notice | Full agreed session price due where permitted by law. |
Please cancel in writing (email is fine). Force majeure or documented illness may be handled flexibly case by case without creating a legal entitlement. These rules do not limit statutory withdrawal rights.
8. Your duties and minimum age
You ensure all participants know the schedule and that you hold rights to lyrics, samples and artwork used. For participants under 16, written consent from a legal guardian is required; below that age an adult supervisor must be present throughout.
Follow studio rules: no smoking indoors, careful use of gear, comply with engineer safety instructions. We may claim compensation for damage to studio property caused by gross negligence.
9. Performance, revisions and quality
We work to professional studio standards; we do not guarantee chart success or specific streaming numbers. Mixing and mastering include 2 revision rounds based on one consolidated feedback list per round unless the quote states otherwise. Further rounds or a new creative direction after approval are billed separately.
Attended sessions allow live feedback; unattended work relies on your references. Deliver files in agreed formats; unusable or incomplete material extends turnaround and may incur extra cost.
10. Files, delivery and archiving
Unless agreed otherwise, finished mixes and masters are delivered as 24-bit WAV; podcast exports follow agreed loudness targets via download link or your drive. Multitracks and project files are released only if included or paid for in the quote.
We store session and project data for 18 months after the last related service, then delete it routinely. You are responsible for backups. Extended archiving can be agreed in writing for a fee. See master delivery formats for format tips.
11. Copyright, neighbouring rights and AI
You retain copyright in works you bring. You indemnify us against third-party claims if material is used unlawfully. For recordings you commission and pay for, usage rights pass to whoever you designate once paid in full, unless we agree differently in writing.
We do not use your recordings to train generative AI models and we do not create AI voice clones without explicit written consent from the person concerned. We publish client references on the website or social media only with your prior approval.
12. Liability
We are fully liable for intent, gross negligence and injury to life, body or health. For slight negligence we are liable only for breach of essential contractual duties, limited to foreseeable typical damage. We are not liable for data loss if you could have avoided it with reasonable backups.
Website content and external links are covered in our disclaimer. Business clients are fully liable for damage they cause to studio property where the law allows.
13. Privacy and processing on your behalf
We process personal data under our privacy policy. If you are a business sending us third-party personal data (guests, musicians), our data processing agreement may apply.
The contact form uses FormSubmit with servers outside the EU; alternatives are described in the privacy policy. Change cookie choices via (stored 182 days, key ncnt_consent_v1).
14. Complaints, law and jurisdiction
Report defects promptly to [email protected] with a clear description and affected files. We will remedy justified issues within a reasonable time or adjust price where the law requires.
Austrian law applies, excluding the CISG. EU consumers keep mandatory protections of their home country. Courts in Wien have jurisdiction for business disputes; consumers use statutory venues.
